Please read these Terms and Conditions of Purchase (“Terms”) carefully before completing any purchase on badass-marketer.com (“Site”). By purchasing or downloading any product from the Site, you (“Customer,” “you,” or “your”) agree to be bound by these Terms. If you do not agree, do not purchase or use our products.

These Terms govern the relationship between you and Moonlit LLC, operating as Badass Marketer (“Company,” “we,” “us,” or “our”). For questions, contact us at hello@badass-marketer.com.

1. Products & Delivery

Badass Marketer sells digital downloadable products, including workbooks, templates, frameworks, and strategy guides (collectively, “Products”). Upon successful payment:

  • You will receive immediate access to your Product via email download link or direct download.
  • Products are delivered in digital format (e.g., .xlsx, .pdf) and are not physical goods.
  • You are responsible for having the software required to open and use the files (e.g., Microsoft Excel, Adobe Acrobat).
  • If you experience a technical issue with delivery, contact hello@badass-marketer.com within 7 days of purchase.

Products are intended for individuals aged 18 and older. By purchasing, you confirm you are at least 18 years of age.

2. Payment

All prices are listed in USD and are charged at the time of purchase. Payment is processed securely through Shopify’s checkout platform and its authorized payment processors. By completing a purchase, you:

  • Authorize the full charge to your provided payment method.
  • Confirm that the payment information you provide is accurate and that you are authorized to use the payment method.

The Company is not responsible for any fees charged by your bank, card issuer, or payment provider in connection with your purchase.

3. Refund & Cancellation Policy

All sales are final. No refunds. No cancellations. Due to the instant digital nature of our Products — which are delivered and accessible immediately upon purchase — we do not offer refunds, exchanges, or cancellations under any circumstances.

By completing your purchase, you acknowledge and agree that:

  • You have read the product description and understand what you are purchasing.
  • Digital products cannot be “returned” once delivered.
  • No refund will be issued regardless of whether the Product has been opened, downloaded, or used.
  • Orders cannot be cancelled once placed.

If you believe there has been a billing error or duplicate charge, contact hello@badass-marketer.com within 7 days and we will investigate and resolve the issue promptly. Please contact us before initiating a dispute with your bank.

Chargebacks: Initiating a chargeback or payment dispute without first contacting us constitutes a breach of these Terms. We reserve the right to contest any fraudulent chargeback and to pursue recovery of all associated fees and costs. See our full Refund & Cancellation Policy for details.

4. Intellectual Property

Ownership: All Products and content available on the Site — including text, design, layouts, frameworks, graphics, and data — are the proprietary property of Moonlit LLC and are protected by applicable copyright, trademark, and intellectual property laws. All rights are reserved.

Limited License: Upon purchase, you are granted a limited, non-exclusive, non-transferable, revocable license to use the Product for your own personal or internal business purposes only. This license does not include the right to:

  • Reproduce, duplicate, copy, resell, or redistribute the Product to any third party.
  • Share login credentials, download links, or file access with others.
  • Modify, adapt, translate, or create derivative works for commercial distribution.
  • Use any Product content in AI training datasets, machine learning systems, or automated content generation tools.

Unauthorized use may result in legal action. If you wish to use any content beyond the scope of this license, contact hello@badass-marketer.com for written permission.

5. Earnings & Results Disclaimer

The Products sold on this Site are educational frameworks and strategy tools. The Company makes no representation, warranty, or guarantee that you will achieve any particular outcome, revenue level, or business result from using our Products. Individual results will vary based on effort, experience, market conditions, and factors outside our control.

By purchasing, you acknowledge that:

  • Success requires your own consistent effort, sound judgment, and execution.

IN ALL CASES, THE COMPANY’S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

8. Indemnification

You agree to defend, indemnify, and hold harmless Moonlit LLC and its members, managers, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of or related to: (i) your use of any Product; (ii) your violation of these Terms; or (iii) your violation of any third-party rights.
